Data, Image, & Digital Asset Addendum
1. Covered Materials
“Covered Materials” include pet photographs, paw/nose/print images, pet names, case identifiers, personalization,
family/customer contact information when supplied, order details, digital models, production files, and related
materials exchanged or created for the Partner Program.
2. Partner Authorization
Partner represents that it has the right and any authorization reasonably necessary to provide Covered Materials to TM
for order fulfillment, customer support, reorders, quality control, and the other uses expressly described in this
Addendum. Partner will not knowingly submit material it is prohibited from sharing.
3. TM Permitted Uses
TM may use Covered Materials to create and fulfill the requested product; communicate about the order; maintain
production and customer-service records; perform quality control; prevent case mix-ups; create and retain a finished
digital Pactile master; fulfill authorized duplicate/reorder requests; and offer the referred family additional Pactiles or
TM products as permitted by the Agreement.
TM will not sell personal information to third parties under this program. Any marketing use of an identifiable pet
photograph, testimonial, family story, or customer identity outside the order/referral relationship requires a separate
legal basis or permission as appropriate.
4. Digital Master Retention
TM may retain the finished digital Pactile master and associated minimum identifying/order information for future
duplicate production, reorders, quality assurance, and recordkeeping. TM may establish reasonable retention/deletion
schedules for raw source files and intermediate production files.
5. Reorders and Family Access
TM may accept subsequent orders from an identifiable referred family for additional Pactiles or other TM products. TM
may use reasonable verification methods before reproducing a retained master. Partner acknowledges that such direct
sales may generate a 5% Partner Referral Credit during the 12-month period stated in the Agreement.
8. Deletion Requests and Legal Retention
TM will reasonably evaluate requests to delete customer-supplied materials, subject to legal, accounting, fraud-
prevention, dispute, backup, and order-history retention requirements and any rights or obligations applicable to the
requesting individual.
